If you have an active contract with an energy supplier you’ll transfer to your new energy contract the day after the current one expires.

The majority of business energy suppliers can switch your businesses electricity and gas supplies in as little as 5 days, this is thanks to the faster switching program introduced in July 2022.

This depends on your type of business, its activities and any arrangements you have with HMRC. VAT on energy contracts also depends on a factor called de minimus, if you use less than 145 kWhs per day of gas or 33 kWhs per day of electricity your bill will be charged at 5% VAT instead of 20%.

Ofgem defines a micro business as one that uses no more than 100,000 kWh of electricity per year or no more than 293,000 kWh of gas per year. Or has ten employees or less and an annual turnover and balance sheet of no more than €2 million.

Your current energy supplier can object to any transfer if you have outstanding debt on your account.

However this debt must be more than 28 days to be eligible for them to raise a legitimate objection to the switch.

An LOA can be given verbally, physically or via docusign. It grants your energy broker authority to negotiate and sometimes transfer your electricity and gas contracts on your behalf.

Typically there are two classifications of LOAs, Level 1 and Level 2.

Level 1 LOAs permit your energy broker to access your industry data, contact your currently supplier to resolve issues and request information and issue termination to your current energy supplier against the required notice period of your current energy contract.

Level 2 LOAs have all the authority of a Level 1 LOA with the added permission to switch energy suppliers on your behalf.

Typically energy brokers will either work on your behalf for an agreed fee or add a commission to your business electricity and gas contracts.

Energy brokers are now required to disclose all fees and commissions relating to your energy contracts.
